General Terms and Conditions for HughesNet residential services purchased July 1, 2008 to present

HughesNet® service is available in the contiguous U.S. with an unobstructed view of the southern sky, and its usage is subject to the Fair Access Policy. Actual speeds vary based on the amount of traffic on the Internet, content on a particular Website, or by the overall performance and configuration of your computer. Stated speeds and uninterrupted use of service are not guaranteed. Actual speeds will likely be lower than speed indicated during peak hours.

Listed speeds are available only through HUGHES’ new satellite. The majority of subscribers will have access to these faster speeds. However, approximately 5-8% will not be able to receive these speeds as a result of trees or other obstacles that block the signal from the satellite to the home. In these cases, Hughes can offer slightly slower Internet access via another satellite with download speeds up to 700 Kbps, 1.0 Mbps, and 1.5 Mbps; and upload speeds up to 128 Kbps, 200 Kbps and 200 Kbps for Home, Pro, and ProPlus service plans, respectively.

Professional installation is required. Monthly service fees apply. Taxes not included.

Service Commitment:

HughesNet Service Plans require a minimum service commitment of 24 months. If you terminate service prior to the expiration of the commitment, you will owe and your credit or debit card will be charged the Termination Fees as described below.

Early Termination: Upfront Purchase
If you cancel your order before installation, you will not be charged.

If you cancel within 30 days of activation,
No termination fees charged. Note: You will not be refunded for installation charges or other fees.
You may choose to return your HughesNet modem and radio for a $200 refund.

If you cancel after 30 days of activation but before the end of your 24-month term commitment:
You will be charged a $400 Service Termination Fee.
You may choose to return your HughesNet modem and radio for a $200 refund.

Lease Plan Details
Qualified customers will pay a $99 upfront fee (at time of activation) and agree to a $9.99 monthly equipment rental fee. The equipment rental fee covers the leasing of the modem, power supply, and radio transmitter. Because the equipment remains the property of Hughes, you are required to return the modem, power supply, and radio when/if you cancel service, both within and out of term. You have 45 days to return the equipment to Hughes. Should you not return the equipment within the allotted timeframe, a $300 Unreturned Equipment Fee (UEF) will be charged. The UEF is based on $100 for the modem and power supply and $200 for the radio transmitter. In the case of a partial return, only modem and power supply or radio, the UEF will reflect only the unreturned portion. You will be given an option at time of cancellation to request an installer to de-install the modem and radio transmitter for a $100 charge. De-install work orders will be processed the same as repair requests are today. The installer will remove the radio transmitter and modem and provide it to you, at which time you become responsible for returning the equipment to Hughes.

Service plan offerings remain the same and require a 24 month term commitment. You can choose any of the six HughesNet service plans. Your service plan selection will be combined with the Equipment Rental Fee on your monthly statement. If you do not fulfill your service commitment, a $400 Early Termination Fee will be applied.

$200 Refund for Returned Equipment
You may return the modem and radio (outdoor transmitter) to Hughes for a refund if you cancel your HughesNet service prior to the end of your term commitment. This equipment must be received in good condition by Hughes, within 60 days of your termination, in order to receive this $200 refund. Hughes will provide instructions on how to de-install and return the equipment. You will not receive a refund for installation charges or other fees. You are not required to return, and Hughes is not obligated to de-install, the antenna, mount, or any cables. If you elect to have the complete system or the antenna, mount and any cables professionally de-installed, you will be responsible for all de-installation charges.

YOU AGREE AND ACCEPT THAT HUGHES NETWORK SYSTEMS, LLC (HUGHES) IS AUTHORIZED TO USE YOUR CREDIT OR DEBIT CARD FOR THE PURPOSE OF: (1) CHARGING YOU FOR THE UPFRONT FEES REQUIRED TO RECEIVE HUGHESNET, INCLUDING PAYMENT FOR EQUIPMENT AND INSTALLATION; (2) CREATING A HUGHES/HUGHESNET CUSTOMER ACCOUNT; (3) CHARGING YOU FOR YOUR MONTHLY SERVICE FEES AND ANY EQUIPMENT OR INSTALLATION FEES THAT MAY APPLY; AND (4) CHARGING ANY APPLICABLE EARLY TERMINATION FEES.

Home Networking:
Home networking equipment is not included with your HughesNet system. For network setup, support, and configuration, contact your network hardware manufacturer and/or operating system software developer. (Hughes is not responsible for home network configuration or management).

Please note that all computers on a home network will be sharing a single connection. Simultaneous use of high-bandwidth applications by multiple users may result in degradation of download and surfing speeds, and are subject to the Fair Access Policy.

Fair Access Policy

To ensure fair Internet access for all HughesNet® subscribers, HUGHES maintains a Fair Access Policy (FAP). This policy establishes an equitable balance in Internet access for HughesNet subscribers. Hughes assigns a download threshold to each service plan that limits the amount of data that may be downloaded during a typical day. A small percentage of subscribers who exceed this limit will experience a temporary reduction of speed.

Explanation:
The Fair Access Policy is straightforward. Based on an analysis of customer usage data, Hughes has established a download threshold for each of the HughesNet service plans that is well above the typical usage rates. Subscribers who exceed that threshold will experience reduced download speeds for approximately 24 hours.

During this recovery period, the HughesNet service may still be used, but speeds will be slower. Web browsing, for example, will be significantly slower than subscribers’ normal browsing experience. Subscribers will return to normal download speeds after the recovery period as long as they minimize their bandwidth-intensive activities. If they continue these activities during this recovery period, reduced download speeds may continue beyond 24 hours.

  • Express Repair Home /. Express Repaire Business – (includes 2nd business day / Next Business Day) coverage, 8am-5pm, Monday through Friday. $29.95 per on-site repair incident in addition to monthly fee. Requires 12-month commitment. $25 administrative fee applies if Express Repair is cancelled before the end of the commitment term.

  • The lease option requires a one time upfront payment of $99. This program adds $9.99 per month to the monthly fee of the program that you choose. This fee exists for the life of your service. Lease Activaion if free after mail in rebates.
